Smartechs LLC – Low Voltage Services

1. Acceptance of Terms
By accessing this website or engaging services with Smartechs LLC agree to be bound by these Terms and Conditions. If you do not agree, you must not use our services or website.
2. Scope of Services
Smartechs LLC provides low voltage services, including but not limited to installation, configuration, and maintenance of networking, security systems, surveillance systems, structured cabling, and related technologies.
All services are provided based on agreed proposals, estimates, or contracts. Any additional work outside the agreed scope may incur additional charges.
3. Work Completion Clause
All work performed by Smartechs LLC shall be considered complete upon installation and initial operational verification.
- Any modifications, reconfigurations, or changes requested after completion will be treated as new work.
- Client acceptance is assumed unless written notice of issues is provided within 48 hours of installation.
4. Payment Terms
- Payment terms will be defined in the service agreement or invoice.
- Late payments may result in service suspension and additional fees.
- Smartechs LLC reserves the right to withhold warranties or support for unpaid balances.
5. Maintenance & Support Requirement
Ongoing technical support, troubleshooting, and system optimization are not included unless the Client has an active maintenance or service contract.
- Clients without a maintenance agreement will be billed at standard service rates.
- Smartechs LLC is not obligated to provide support without an active agreement.
6. Client Responsibilities
The Client agrees to:
- Provide accurate project requirements and site access
- Ensure proper power, internet, and environmental conditions
- Maintain secure access credentials for installed systems
- Not modify installed systems without notifying Smartechs LLC
7. Limitation of Liability
To the fullest extent permitted by law, Smartechs LLC shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of data, revenue, or business interruption
- Failures due to third-party equipment, software, or internet services
- Improper use, tampering, or unauthorized modifications
Total liability, if any, shall not exceed the amount paid by the Client for the specific service in question.
8. Cybersecurity Disclaimer
Smartechs LLC does not guarantee cybersecurity protection.
- We are not responsible for hacking, data breaches, unauthorized access, or cyberattacks affecting installed systems.
- Clients are solely responsible for maintaining secure passwords, firewalls, updates, and network security practices.
- Any cybersecurity services must be explicitly agreed upon in writing.
9. Warranty Disclaimer
Unless otherwise stated in writing:
- Equipment warranties are provided solely by the manufacturer
- Labor warranties are limited and defined per project agreement
- No guarantees are made regarding system performance beyond installation
10. Indemnification
The Client agrees to indemnify and hold harmless Smartechs LLC from any claims, damages, losses, or expenses arising from:
- Misuse of installed systems
- Failure to maintain systems
- Violations of laws or regulations
- Third-party claims related to system usage
11. Arbitration Clause
Any dispute, claim, or controversy arising out of or relating to services provided by Smartechs LLC shall be resolved exclusively through binding arbitration.
- Arbitration shall be conducted in the state where Smartechs LLC operates
- The parties waive their right to a jury trial or participation in class actions
- Each party shall bear its own legal costs unless otherwise determined by the arbitrator
12. Force Majeure
Smartechs LLC shall not be held responsible for delays or failures due to events beyond its control, including but not limited to natural disasters, power outages, supply chain disruptions, or acts of government.
13. Termination
We reserve the right to terminate services at any time due to:
- Non-payment
- Breach of these Terms
- Unsafe working conditions
- Client misconduct
14. Governing Law
These Terms shall be governed by and interpreted under the laws of the applicable state in which Smartechs LLC operates.
15. Changes to Terms
Smartechs LLC reserves the right to modify these Terms at any time. Updated versions will be posted on the website with a revised effective date.
